TERMS OF ENGAGEMENT

The following terms apply:
1
Fees raised in non-litigation matters will be based on hourly rates, which may vary depending on the complexity and urgency of the matter, the risks involved and the experience of the attorney dealing with the matter.

In litigation matters the fees raised will be the higher of the applicable court-tariff or the hourly rates of the attorney dealing with the matter.

It shall be the client’s responsibility to enquire the rate applicable.

The hourly rate so quoted does not include VAT and for this purpose a VAT-invoice shall be forwarded to client.

Fees raised do not include disbursements which shall appear separately on statements / VAT-invoices.

All fees and disbursements are payable on date of statement/VAT-invoice;

It may be required that a deposit be paid prior to commencement with work and that the deposit, which may have to be supplemented by further payments when required may be applied to pay for fees and disbursements as and when raised /incurred.

Client shall have the right to request that an itemised bill of cost be prepared and presented for taxation.

In terms of the Financial Intelligence Centre Act No 38 of 2001, this firm is an accountable institution and legally obliged to establish and verify the source of all funds which will be utilized in the process of this transaction, as well as the full identity and personal particulars of the parties involved in the transaction.   Although all information will be treated as confidential, the aforementioned  Act imposes a reporting duty on accountable institutions under certain circumstances, which, according to the Act, overrides such confidentiality.

Any cash deposit above R49 999.99  must be reported to the Financial Intelligence Centre (Government) in terms of legislation, you will also be responsible for the disbursement charged by the Bank for the cash handling fee.

Kindly note that our statements are payable within 30 days and we reserve the right to suspend work without notice on all matters if any balance goes beyond 60 days.
